03 - Romania - Specific legislative framework

The general legal framework for organising and functioning of the national education system, including higher education, is established within the Education Law (Law 84/1995). Implementation of the general provisions of the law is ensured through Decisions of the Government and Orders of the Minister of Education, Research and Youth and of other central public authorities. A succinct selection of the legislation acts related to higher education includes:

Decision of the Government 57/1992 regarding certain measures concerning the scientific research, design, expertise and consulting activities within higher education institutions; Law 88/1993 regarding higher education institutions accreditation and diploma recognition (amended through Law 144/1999);
2. Decision of the Government 528/1994 regarding approval of regulations for the National Council for Academic Evaluation and Accreditation and of the evaluation commissions (amended through Decision of the Government 243/1999);
3. Decision of the Government 689/1994 regarding granting of study, doctoral and specialisation scholarships and other forms of support for youngsters of Romanian origin or Romanian citizens living abroad (amended through Decision of the Government 630/1998 and 968/2000);
4. Law 71/1995 regarding the right of private high school, post-high school and higher education graduates to undertake the final exams at similar public units and institutions (amended through Law 64/1997, 60/2000 and 131/2000);
5. Decision of the Government 859/1995 regarding scholarships and other forms of material and financial support for children, pupils, students and individuals attending public education (republished);
6. Order of the Minister of Health 1955/1995 regarding the approval of the hygiene Norms for institutions that ensure care, education and instruction of the children and youngsters;
7. Decision of the Government 309/1996 regarding reduction by 50% of the fare costs for local surface and underground transportation, as well as for internal auto, railway and naval transportation for pupils and students in public and private accredited education (amended through Decision of the Government 1187/2000 and 1367/2003);

The assembly of rights and obligations, as well as the norms that regulate the university community activity within each higher education university area are established through the University Charter of the higher education institution, adopted by the university senate.
